E) The conditions referred to in paragraph 1, shall not apply if the storage or obtaining access to information referred to in para. 1, is necessary for:

a) performance of message transmission through a public telecommunications network;

b) providing a telecommunications service or a service provided electronically, requested by the subscriber or end user (...)
